1. Duration of the agreement
a) The first two hours after expiration of the agreement are free of charge.
b) If the agreed period is overloaded with more than 12 hours, then this has to be agreed with the owner, if not, then the owner has the right to report the vehicle as stolen, and the recuperation of the vehicle will be done on the renter.

2. Taking over the vehicle
The vehicle will be rented and has to be returned with full tank. If the car is not returned with full tank then the renter has to pay 2 Euro/litre.

3. Responsibilities and guarantees
   A. Responsibilities of the renter
   a) to be at least 21 years old and possess a driving license category according to the rented vehicle
   b) to use the car with the care of a good owner
   c) to return the car at the hour and location established within the agreement
   d) to declare all additional drivers
   e) not to rent the car
   f) not to transport more persons as the number referred to within the driving papers
   g) not to involve the car in street races, off-road races or hunting activities
   h) not to use the car for other purposes then the ones for which the car was designed for, thus according to the conditions of the manufacturer
   i) not to transport persons or goods per cost
   j) not to transport products, valuable documents or money without possessing valid papers for it
   k) in case of any damage the nearest auto service will be reached and the owner will be informed.
      For repairs that cost more than 20 Euro the owner consent is necessary.

   B. The renter should cover entirely all damages as result of the following events:
   a) damage of the car as result of entering a flooded zone or a river passage
   b) damage of the gearing
   c) damages that were premeditated
   d) damages produced while braking the law regarding driving on public roads, even if these facts did not take place on a public road, and also those damages that were the result of premeditated offences
   e) damages produced by the driver under alcohol, drugs, or dopes influence, and also if the driver refused alcohol or fatigue test
   f) damages done if the driver was not the owner of a driving license, the license category was not suitable for the rented vehicle, the license was suspended / canceled or the license was detained in order to be suspended / canceled without having a temporary driving authorization
   g) the damage of the car was performed at the time of passing a tunnel or a rail-road intersection
   h) damages done by serious fault of the driver. Serious fault means: leaving the vehicle in unpopulated areas, or abandoning the car in case of a bottle-neck except the case when this is asked by the police in case of force majeure, or when the life of the vehicle occupants is endangered.
   i) in case of theft, together with the prove (protocol) issued by the police department, the renter does not present the car papers and keys
   j) in case Art 3, letter A, points: d,e,g,h are not respected

4. Responsibilities of the owner
The owner undertakes to make the car, object of this agreement, available to the renter, in good operating state according to the legal technical provisions.
The oil and maintenance of the car are responsibilities of the owner.
The FULL-CASCO and the RCA insurances are included within the price and are responsibilities of the owner.

5. Behavior in case of car crash
In case of car crash the police will be informed and measures will be taken to write down the record.
The evidences (eye witness, marks) will be maintained and the name and address of the witnesses will be kept. The renter is banned to admit the guilt (endangering the insurance).

6. Payment method
The payment is done by signing a contract with a CEC, Credit Card, cash or Post Office in the owner fond. Corporate contracts are an exception.
The will be paid in 10 working days time from the invoice release date. In case of failure to pay on the agreed date, penalties of 1% a day of the invoice value will be applied.

7. Fees
All costs referring to the usage of the car (road fees, parking fees, penalty payments, etc.) are covered 100% by the renter.

8. Returning the vehicle
The vehicle will be returned on the date, at the time and in the place agreed in the contract. Returning the vehicle outside the timetable can be done for a fee that is agreed in the contract.
Returning the vehicle can be done in different places settled in the contract. The fee for this is 0,30 Euro/Km.

9. Force Majeure
Each event independent from the will of the parties, after the signing date of the agreement and the performance of it is interrupted is considered force majeure and exempts from responsibility the party notifying this event. Considered as force majeure, in terms of this clause, are events as war, revolution, floods, embargo.

10. Litigation
Any litigation coming from or being connected to the present contract, regarding it’s validity, interpretation, fulfilling or canceling it will be solved by The Court Of Commercial Arbitration with The Chamber of Commerce, Industry and Agriculture Timisoara according to it’s Arbitration Procedure Rules. The sentence will be final and mandatory for both parts.
